EB-1 Priority Worker Multinational Executive or Manager

The following is summarized from the U.S. Citizenship and Immigration Service Regulations at 8 CFR 204.5(j)(3). 

A petition for a Multinational Executive or Manager must be accompanied by a statement from an authorized official of the petitioning U.S. employer which demonstrates that:

  1. If the foreign national is outside the U.S., the statement must confirm that in the three years immediately preceding the filing of the petition the foreign national has been employed outside the U.S. for at least one continuous year in a managerial or executive capacity with the petitioning corporation, or by its parent, affiliate, or subsidiary;
  2. If the foreign national is already in the U.S. working for the petitioning employer, the statement must confirm that in the three years preceding entry to the U.S. as a nonimmigrant, or if the foreign national was employed overseas for at least one of the preceding three years in a managerial or executive capacity with the petitioning firm or corporation, or by its parent, affiliate, or subsidiary;
  3. The offered position in the U.S. is a managerial or executive position; and
  4. The prospective employer in the U.S. has been doing business for at least one year.
An outstanding researcher petition is exempt from the Labor Certification process required for other employment based immigrant petitions.
