USCIS Reverses Itself -- Will Accept EB I-485 Adjustment Applications Through August 17, 2007

On July 17, 2007, U.S. Citizenship and Immigration Service (USCIS) issued a "USCIS Update" announcing that USCIS (1) will not reject employment-based I-485 adjustment of status applications already properly filed on or after July 2, 2007 and (2) will allow eligible foreign nationals to file employment-based adjustment of status applications in a 31-day period from July 18, 2007 through August 17, 2007. USCIS confirmed that that this action will offer eligible foreign nationals the same one-month filing window they would have had if USCIS' had not stopped accepting I-485 adjustment applications on July 2nd.

Additionally, USCIS agreed that the current filing fee schedule will apply to adjustment of status, advance parole, and employment authorization applications filed through August 17th. Although the new fee schedule will be applicable to all other applications on July 30th, the new fees will be postponed until August 17th for employment-based adjustment of status and collateral filings.
